For the purpose of this chapter the alphabetical list of words below shall have the following definitions:

“Adoption” means granting tribal membership to individuals who meet specific requirements prescribed in this chapter.

“Area Director” means the Area Director of the Sacramento Area Office of the Bureau of Indian Affairs or his authorized representative.

“Base roll” means the Revocation of Termination Proclamation and Restoration of Federal Status Notice for Robinson Rancheria as published in the Federal Register on June 29, 1977 (42 F.R. 33099).

“Burden of proof” means the duty to positively prove a fact (or set of facts).

“Citizens business council” means the governing body of the Robinson Rancheria which shall approve or disapprove applications for enrollment.

“Collateral relatives” means descendants from the same ancestor, but not from one another, namely: aunts, uncles, brothers, sisters, cousins, etc.

“Descendant” means those persons who are the direct issue of an ancestor through whom enrollment is claimed, namely: children, grandchildren, etc. It does not include collateral relatives.

“Disenrollment” means an affirmative action to deprive a member of the right to tribal enrollment.

“Dual enrollment” means enrollment in more than one tribe.

“Due process” means a course of legal proceedings according to the rules and principles established for the protection of individual rights. The fundamental requirements of due process are notice and an opportunity to be heard and shall comply with the “Indian Civil Rights Act of 1968.” When a governmental body makes a decision affecting the life, liberty, or property of an individual, the government must provide an opportunity to the individual to defend those rights, and in reaching a decision, the government must not act unreasonably.

“Lineal ancestor” means an ancestor, living or deceased, who is related to an applicant by direct ascent, namely: parent, grandparent, etc. It does not include collateral relatives such as: aunts, uncles, etc.

“Marriage” means a union between a male and female recognized by a state or tribe as legal wedlock.

“Ordinance” means a law that establishes how to do something and regulates rights. An enrollment ordinance sets up procedures by which membership decisions are made fairly and justly.

“Paternal” means of or relating to a father.

“Paternity statement” means a written statement signed by the father of the child stating that he is the father.

“Petition for marriage recognition” means a petition filed with the citizens business council to establish that a marriage exists.

“Recognized member” means a person whose name is listed on the membership roll of another tribe or Rancheria or has received a land use assignment on another reservation.

“Relinquishment of membership” means personal action in writing by a tribal member to sever his tribal relationship.

“Sponsor” means a parent, recognized guardian, next friend, next of kin, spouse, executor, administrator of estate, or other persons who file an application for enrollment on behalf of another person.

“Spouse” means a husband or wife.

“Superintendent” means the Superintendent of the Central California Agency of the Bureau of Indian Affairs or his authorized representative.

“Tribal authority” means a duly appointed enrollment committee to regularly review enrollment applications and make recommendations on the applications to the citizens business council.

“Tribal council” means all enrolled members of the Robinson Rancheria, 18 years of age or older. [Ord. 1 § 1, 1985.]
