(1) At the conclusion of all balloting and the closing of the polls, all ballot boxes shall be transported in the presence of at least one committee member to a location specified by the committee and accessible to members, of the Rancheria. The ballot boxes shall remain locked until the committee is present. All ballots will be recorded and counted in the presence of the committee and in the presence of any person, so desiring.

(2) In any election the election shall be valid only if at least 30 percent of the eligible voters vote. Absentee ballots shall be included in this 30 percent.

(3) The business council members shall be elected by a majority of the votes cast, provided at least 30 percent of those eligible to vote, voted. In the event that no candidate receives a majority of the votes cast or in the event that at least 30 percent of the voters do not participate in the elections, a subsequent election will be held. The subsequent elections shall be limited to the two candidates receiving the highest votes to insure one candidate receives a majority of the votes cast.

Any candidate for tribal office who runs unopposed, in an election deemed valid, shall be elected if the candidate receives a majority of the votes cast. If an unopposed candidate fails to receive a majority of the votes cast, the committee shall conduct a special election.

In the event that the ballot count revealed that two candidates for the same position have received the same number of votes, then a recount will be made. If a tie exists at the completion of the recount, the committee will call a special “run-off” election limited to the tied candidates. The run-off election shall be held not more than 30 days from the date of the election which the tie vote occurred.

(4) Following the elections, the committee shall prepare a report of the elections and certify to its accuracy and shall post the voting results, and send a copy of the report to the Bureau of Indian Affairs, Central California Agency, Sacramento, California, within five working days after the elections.

(5) All election material shall be kept under lock and key, for 30 days in the event of a protest or order for a recount. [Res. 1-18-86-B Art. X, 1986.]
