(1) Any election other than the annual tribal election shall be deemed to be a special election.

(2) Special elections, unless otherwise specified in the provisions of this chapter, shall be conducted in the same manner as an annual tribal election. Those special elections which must be conducted within a 30-day period, as set forth in this chapter, and the candidates already being known in those instances, the committee shall proceed with the elections in the same manner as specified in the election procedures, which govern the conduct of elections 30 days prior to the annual tribal election with the exception that the announcement of eligible candidates shall be at least 20 days prior to the special election date.

(3) For purposes of this section, special elections shall be conducted when, but not limited to, the following reasons:

(a) An election is declared invalid as a result of less than 30 percent of the eligible voters voting.

(b) A special “run-off” election is required.

(c) An election is declared invalid by the business council upon substantiation of discrepancies in any election, and it is determined that said descrepancies can only be resolved through special election.
