(1) All applicants must make application to the business council for an assignment of tribal land. Applications for assignments shall be filed with the secretary of the business council and shall be in writing, setting forth the name of the person applying for the land, sufficient information to show that the applicant meets all of the requirements set forth in RRTC 3.10.040, and as accurate a description of land desired as circumstances will permit.

(2) The business council shall review all applications in the order in which they are received to determine whether they are properly prepared and to check whether applicants meet all eligibility requirements of this chapter.

(3) The business council within 60 days from their receipt thereof, properly prepared, shall by formal resolution either approve or disapprove the application. Within 15 days after rendering a decision the council shall proceed as follows: When an application is approved by the business council, an assignment instrument shall be issued to the assignee by the business council, which shall also forward a copy thereof to the Superintendent. When an application is disapproved the business council shall return all rejected applications to the applicant by letter, advising as to the reason or reasons for such rejection.

(4) The business council shall maintain a permanent record on each individual assignment including actions taken in regards to any disposition of applications thereof.

(5) All land assignments shall be surveyed by business council. No assignment shall be made unsurveyed areas or on lots considered to be valuable to the band as a tribal holding conservation or commercial purposes. [Ord. 4 Art. VI.]
