(1) Assignments which are granted pursuant to this chapter are granted for the specific purpose of providing a homesite and for purposes of being put to other similar personal beneficial uses. Assignments so granted are subject to cancellation for violation of any of the following provisions:

(a) The assignee shall utilize the assigned tribal land in a careful, economical and conservation minded manner in accordance with local and accepted soil conservation practices.

(b) The assignee shall comply with all terms of this chapter as well as with the terms of any agreements entered into respecting said assignment, including but not limited to agreements respecting housing on said assignment.

(c) Absent prior written consent of the business council for nonuse of the assignment for good cause shown, failure of the assignee to use the assignment for a period of 12 consecutive months shall be sufficient cause for cancellation. In the event that unforeseen circumstances justify additional time, or if an assignee is unable to establish residence on his/her assigned land as a result of pursuing education goals off the reservation or is serving in the military, a reasonable extension shall be granted by the business council.

(d) Any attempt by the assignee to lease or rent the land without prior consent of the business council shall be sufficient cause for cancellation.

(e) The assignment and improvements thereon shall be maintained in a neat manner and subject to any sanitation regulations existing at the time the assignment is made and to any sanitation regulations which may be enacted subsequently by the council.

(f) Assignments shall not be used for unlawful purposes.

(g) Transferring, assigning or exchanging an assignment without the approval of the business council.

(h) Any attempt by the assignee to grant easements or rights-of-way without prior consent of the business council and approval of the Secretary of the Interior or his authorized representative shall be sufficient cause for cancellation.

(i) Removing improvements which are part of the real property without authority from the business council.

(j) Creating a public nuisance, allowing conditions to exist which would endanger life or the property of any assignee.

(2) The maximum penalty for violation of any provisions of this chapter shall be the cancellation of the assignment and the ejection of an assignee from the assignment. A violation of any regulation promulgated under this chapter shall be a violation of this chapter.

(3) Any person who shall violate a provision of this chapter shall be served 15 days’ written notice to appear before the tribal council. Each person appearing before the tribal council shall be given an opportunity to be heard including the right to be represented by counsel and the right to present witnesses on his/her behalf.

(4) The tribal council shall make a determination as to whether or not there has been a violation of this chapter. Upon finding that an individual has intentionally violated a provision of this chapter, including failure to rectify a determined violation within a reasonable time period or as more particularly prescribed by the council, the tribal council shall cancel the assignee’s assignment period, or in the alternative, the tribal council may impose a monetary fine not to exceed $500.00 in lieu of cancellation of the assignment.

(5) Cancellation of the assignment shall be mandatory for more than one violation of this chapter within a period of one year. [Ord. 4 Art. IX.]
