(1) The Robinson Band intends to dedicate 51 percent of its net gaming revenue to the following purposes and in approximately the percentages set forth in this section:

(a) Twenty-five percent of net gaming revenue shall be used to fund tribal governmental operations or programs;

(b) Fifteen and one-half percent of net gaming revenue shall be used to provide for the general welfare of the tribe and its members, not including per capita payments, through programs and services, including emergency loans and other need-based disbursements as determined from time to time by the citizens business council;

(c) Ten percent of net gaming revenue shall be used to promote tribal economic development, including but not limited to developing and/or expanding tribal business enterprises, land acquisition, pursuit and development of nongaming business opportunities, purchase of goods and services that may provide employment and financial returns for the Robinson Band its members, and business development loans to tribal members;

(d) One-half of one percent to donate to charitable organizations and help fund operations of local government agencies.

(2) Not more than 49 percent of net gaming revenue shall be paid as per capita distributions to eligible tribal members.

(3) The citizens business council shall ensure that a monthly accounting is made of net gaming revenues, and that each month, or other applicable period of disbursement, the appropriate percentages of such net gaming revenues are earmarked and set aside for the expenditures described in subsections (1)(a) through (1)(e) of this section.

(4) The citizens business council shall determine the manner of and schedule for spending and distributing net gaming revenue as directed in subsections (1)(a) through (1)(e) of this section; provided, however, the citizens business council shall make per capita payments to eligible tribal members, bimonthly payment, not less than six times per calendar year for that purpose.
