As used in this chapter, the following terms shall have the following meanings:

“Business” includes all activities engaged in with the object of profit or nonprofit benefit, advantage to a taxpayer, or to another person or class directly or indirectly.

“Business council” shall mean the Robinson Rancheria business council.

“Collector” means the person or persons designated by the business council to collect the business license fees established under this chapter for the tribe.

“Contractor” means any person, except those persons who have a professional services contract with the tribe whereby he or she works only in a contracted professional capacity on a consistent basis (i.e., tribal attorney(s), tribal court judge(s)). All other contractors that submit a bid to, or does him/herself or by or through others, construct, alter, repair, add to, subtract from, improve, move, wreck, or demolish any building, street, road, excavation or the structure, project, development or improvement, or do any part thereof, including the erection of scaffolding or other structures or works in connection therewith. The term “contractor” includes subcontractor or specialty contractor, but does not include anyone who merely furnishes materials or supplies without fabricating them into, or consuming them in the performance of, the work of the contractor.

“Employee” means all persons engaged in the operation or conduct of any business, whether as owner, any member of the owner’s family, partner, agent, manager, and any and all other persons employed or working in said business.

“Engaging in business” shall mean commencing, conducting or continuing in business as defined in this section, as well as the exchange of corporate or franchise powers, liquidating a business when the liquidators thereof hold themselves out to the public as conducting such business.

“Fixed place of business” means the premises where a business is regularly transacted and where the circumstances show an intention to be an established part of the business community on the reservation.

“Hawker” or “peddler” means and includes any person who engages in a temporary or transient business on the reservation selling or advertising for sale of goods, wares, merchandise of any kind or any other thing of value, and who, for the purpose of carrying on such business, rents, leases, occupies or uses any room, doorway, vacant lot, building, or any other place within the reservation for exhibition or sale of goods, wares, merchandise or other things of value. If the place in which the business is conducted is rented, leased or occupied for a period of 90 days or less, such fact shall be presumptive evidence that the business carried on therein is a transient business.

“Person” shall mean any individual, receiver, assignee, trustee in bankruptcy, trust, estate, firm, partnership, domestic or foreign corporation, association, society, or any group of individuals acting as a unit, whether mutual, cooperative, fraternal, nonprofit or otherwise, and any other Indian tribe, whether or not recognized by the United States. The term shall not include the tribe or any of its business.

“Professionals” means and includes, but is not limited to, doctors, dentists, attorneys, engineers, licensed surveyors, certified public accountants or any other person holding a certificate or degree of any professional organization or any license from a state licensing agency to provide professional services.

“Retailer” means any person engaged in the dispensing or distribution of merchandise or goods to the ultimate consumer.

“Reservation” means all land within the exterior boundaries of the Robinson Rancheria and all land that is owned by the United States of America in trust for the tribe.

“Sale” shall mean the exchange of property and/or any transfer of the ownership of, title to, or possession of, property for valuable consideration, including exchange or barter, in any manner or any means whatever. It includes conditional sales contracts, leases with option to purchase, and any other contract under which possession of the personal property is given to the purchaser but title is retained by the vendor as security for the payment of the purchase price. It shall also include the furnishing of food, drink, or meals, for compensation, whether or not consumed upon the premises or place of sale.

“Solicitor” or “canvasser” means any person who goes from house to house, or from place to place on the reservation, selling or taking orders for, or offering to sell or take orders for, any goods, wares, merchandise, or any article for future delivery, or for any service or services to be furnished or performed in the future, or for the making, manufacturing, treating or repairing of any article or things whatsoever, for future delivery.

“Tribe” shall mean the Robinson Rancheria.

“Vehicle” means every device in, upon, or by which any person or property is or may be transported upon any public street or highway, except devices moved by human power or used exclusively upon stationary rails or tracks. [Ord. 05-31-2018-A § 2(4.01.010), 2018.]
