(1) Any person guilty of a violation of this chapter shall be subject to punishment of a fine not to exceed $500.00 per violation as civil damages to defray the tribe’s cost of enforcement of this chapter. In addition to any fines so imposed, any license issued hereunder may be suspended or cancelled by the commission for the violation of any of the provisions of this chapter, or of the tribal license, upon hearing before the commission after 10 days’ notice to the licensee. The decision of the commission shall be final.

(2) Any person suspected of having violated any provision of this chapter shall, in addition to any other penalty imposed hereunder, be required to surrender any liquor or beer in such person’s possession to the officer making the arrest or complaint. The surrendered beverages, if previously unopened, shall only be returned upon a finding by the court after trial that the individual committed no violation of this chapter.

(3) Any licensee who violates the provisions set forth herein shall forfeit all of the remaining sock in the outlet(s). The commission shall be empowered to seize forfeited products.

(4) Any stock, goods or other items subject to this chapter that have not been registered, licensed, or taxes paid shall be contraband and subject to immediate confiscation by the commission or its employees or agents; provided, that within 15 days of the seizure the commission shall cause to be filed an action against such property alleging the reason for the seizure or confiscation and shall hold a hearing in accordance with the procedures set forth in RRTC 5.15.080(6).
