(1) Upon the issuance of an Order After Hearing, as described in RRTC 1.15.030(2) or 9.52.40, excluding a person form the reservation, the business council shall give public notice of the order and any subsequent discharge of the order, by the following means:

(a) By posting the notice for a period of five days at the tribal office and at the entrance to the housing project, the reservation and any house or structure located on any expired leasehold, assigned or unassigned tribal lands occupied or used by the person to be excluded. The business council may establish signs at the entrance to the reservation and the housing project, stating: “Entrance Prohibited to Persons Excluded by Order of the Business Council. No Trespassing by Such Persons. Prohibited Entry Subject to Criminal to Penalties. (Cal. Penal Code §602.)”

(b) By mailing notice to the person to be excluded if their mailing address is known.

(c) By mailing notice to the Lake County sheriff’s department and the Bureau of Indian Affairs, Office of Justice Service (“OJS”) or any police officer holding a special law enforcement commission (“SLEC”) issued by the OJS that has the authority to enforce tribal law on the reservation pursuant to an agreement between the tribe and the OJS.

(2) The notice shall be in the form and contain the statements set forth in Form 0.5, attached hereto and incorporated herein.

(3) After the issuance of the notice provided in this section, the business council or the housing department shall not rent any housing under its management and/or lease or assign any tribal trust land to a person excluded from the reservation under this chapter or to any person who violates RRTC 1.15.010(2), and, in the event the person has a valid lease or assignment, shall terminate the lease and/or assignment with and take all steps legally required to evict or eject any such person.
