A claim against an elected official, employee, or officer in his/her official capacity is another way of pleading an action against the tribe. Accordingly, the tribe must receive notice and an opportunity to respond. To the fullest extent of the law, an official capacity suit is subject to the defense of sovereign immunity. If an official capacity suit can overcome the defense of sovereign immunity, it is limited to prospective injunctive relief. [Ord. 05-31-2018-C § 2(02.05.03.010), 2018.]
