To the extent applicable under federal law, an elected official, employee, or officer enjoys sovereign immunity from suit, except as otherwise provided by ordinance of the council, cannot be sued without the consent of the council and is not liable for any injury resulting from his/her act or omission where the act or omission was the result of the exercise of the discretion vested in him/her, whether or not such discretion be abused or is the result of negligence on the part of him/her; provided, that the negligent act occurred while the elected official, employee, or officer was carrying out the duties of his/her position, employment, or office.
