The tribe has the right and duty to defend its elected officials, key employees, and officers against any suit seeking compensatory and/or punitive damage as long the claim is brought against the elected official, key employee, or officer for acting within the scope and course of their position, employment, or office, and they were exercising discretionary authority and functions.
