The tribal court may choose not to impose a fine for a period not to exceed one year if justice so requires and the following criteria are met:

(1) The person has not committed any previous violations of this title; and

(2) The person does not commit any other violations of this title during the time the penalty is deferred or suspended; and

(3) The person does not commit any infractions, violations or violations in any other jurisdictions during the time the penalty is deferred or suspended; and

(4) The person complies with all tribal court orders concerning the violation to the best of his or her ability. [Ord. 12-15-2021A § 9.2, 2021.]
