(1) It is unlawful for any person who is under the influence of an alcoholic beverage or any drug to drive a vehicle.

(2) It is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle as measured by a preliminary alcohol screening device. Results from a PAS device, driving pattern, and observation of the offender during the officer’s investigation shall be sufficient evidence to substantiate a violation of this chapter.

Commentary: Adjudicators may refer to California Vehicle Code Section 23152. If there is any conflict between this provision and the California Vehicle Code, this code shall supersede the California Vehicle Code.
