(1) Any person, as directly affected by a decision of the committee shall have the right of appeal. Appeals shall be made in writing, and submitted to the business council and the business council must grant a timely hearing. Any decision of the business council shall be final and made in writing.

(2) Any potential candidate, who has been disqualified by the committee shall have the right of appeal. The potential candidate shall have until 10 days after a determination by the committee of eligible candidates, to submit a written appeal to the business council. The business council must decide on the appeal no later than 15 days prior to the election. Only the written evidence of the committee, and written evidence of the potential candidate, shall be considered by the business council. Any decision of the business council shall be final and made in writing. In the event that a potential candidate prevails in his/her appeal, the committee shall prepare a special notice announcing that person as a candidate and said notice shall be mailed to each eligible voter at least 10 days prior to the election. The candidate’s name shall be placed on the ballot.

(3) Any appeals or complaints which protest the conduct of any election or the results thereof, shall be made in writing and submitted to the business council within 30 days following an election. Any appeal or complaint filed after the thirtieth day shall not be considered by the business council. The business council shall render a written decision to the appellee or complainant by the forty-fifth day after the election date. [Res. 1-18-86-B Art. X, 1986.]
