(1) Any disputes arising from alleged commission acts or omissions shall first be brought to the commissioners for resolution. If not resolved by the commission, the dispute shall be addressed to the business council whose decision shall be final and binding, unless the business council authorizes review by a court of competent jurisdiction.

(2) This chapter does not waive the sovereign immunity of the tribe or the commission, however, the commission, with the advice and consent of the business council, may sue and consent to be sued upon any contract, claim or obligation arising out of its activities under this chapter, on a case-by-case basis and only to extent necessary to do business or protect the resources of the commission.

(3) The commission and professional staff of the commission, when acting within the course and scope of their authority under this chapter and tribal law, are agents of the tribe and share the tribe’s sovereign immunity from un-consented suit, unless the business council expressly waives such immunity.
