(1) No Compensation for Services Rendered. No commissioner may be compensated by the commission for services rendered to the commission, whether as an employee, independent contractor, or otherwise.

(2) No Interest in Project. During his or her tenure and for one year thereafter, no commissioner or business council member shall voluntarily acquire any interest, direct or indirect, in any housing project or in any contract or proposed contract relating to any project. If any such commissioner, officer or employee involuntarily acquires any such interest, or voluntarily or involuntarily acquired such interest prior to appointment or employment as a commissioner, officer or employee, he or she shall immediately disclose his or her interest in writing to the commission and such disclosures shall be entered upon the minutes of the commission. Such commissioner, officer or employee shall recluse him or herself and not participate in any action by the commission relating to the property or contact in which he or she has such interest. Any violation of the foregoing shall constitute grounds for removal from office and/or from the commission.

(3) Abstention When Conflict of Interest. On any motion, before the commissioners approve, review or comment on a proposal or contract that would benefit any person, business, institution, or agency, a commissioner shall not participate (but may be counted as present in order to determine a quorum) in any discussion and shall abstain from voting if such commissioner:

(a) Has a financial interest in the person, business, institution or agency; or

(b) Is employed by the person, business, institution or agency associated with it in a responsible capacity with compensation; or

(c) Is employed by a firm or company that has a financial interest in the proposal or contract or provides services to the person, business, institution or agency.

(4) Indian Preference. Notwithstanding the provisions of this section, the commission shall comply with all applicable federal and tribal law in giving preference to bids, services, and contracts from Indian-owned or operated firms. The commission may accept proposals, bids or contracts from companies owned, operated or directed by the commission, under applicable federal and tribal Indian preference rules, provided the proposal, bids or contracts meet any standards set forth by the commission, and provided the interested commissioner complies with the other requirements of this section.

(5) Nepotism. Any action taken by a commissioner that shows undue favoritism to immediate family as determined by the commission or business council in their sole discretion is considered nepotism. For the purpose of this section, immediate family (whether by blood, adoption or marriage) is defined as:

(a) Parent.

(b) Spouse.

(c) Siblings.

(d) Child.

(6) Execution of Checks, Drafts and Notes. Except as otherwise specifically determined by resolution of the business council, or as otherwise required by law, checks, drafts, promissory notes, orders for the payment of money and other services of ineptness of the commission shall be approved and signed by the not less than two commissioners’ authorized signatures.
