Unless otherwise required by the context, the following words and phrases shall have the following meanings:

“Alcohol” is that substance known as ethyl alcohol, hydrated oxide of ethyl, or spirit of wine, which is commonly produced by the fermentation or distillation of grain, starch, molasses or sugar, or other substances including all dilutions and mixtures of this substance.

“Alcoholic beverage” shall mean the same as “liquor” defined herein.

“Beer” shall mean any beverage obtained by the alcohol fermentation of an infusion or decoction of pure hops, or pure extract of hops, and pure barley malt or other wholesome grain of cereal, and sugar in pure water containing not more than four percent of alcohol by weight.

“Beer outlet” shall mean a tribally licensed retail sale business selling beer within the Robinson Rancheria Indian Country, including all related and associated facilities under the control of the licensee. Moreover, where a licensee’s business is carried on as part of the operation of an entertainment or recreation facility, the “beer outlet” shall be deemed to include the entire entertainment or recreation facility and associated areas.

“Business council” shall mean the Robinson Rancheria citizens business council as constituted by Article IV of the Constitution of the Robinson Rancheria.

“Commission” shall mean the Robinson Rancheria liquor and beer control commission established pursuant to RRTC 5.15.060.

“Licensee” shall mean any person 21 years of age or older, properly licensed by the tribe to operate a liquor and/or beer outlet.

“Liquor” shall mean the four varieties of liquor, commonly referred to as alcohol, spirits, wine, and beer in excess of four percent of alcohol (“strong beer”), and all fermented, spirituous, vinous or malt liquor or any other intoxicating liquid, solid, semi-solid or other substances patented or not, containing alcohol, spirits, wine, or beer in excess of four percent of alcohol, and intended for oral consumption. The following shall be conclusively deemed intoxicating: every liquid, solid, semi-solid or other substance, patented or not, containing alcohol, spirits, wine or beer, and all drinks or drinkable liquids and all preparations or mixtures capable of human consumption, which contain more than one percent of alcohol by weight.

“Liquor outlet” shall mean a tribally licensed retail sale business selling liquor within the Robinson Rancheria Indian Country, including all related and associated facilities under the control of the licensee. Moreover, where a licensee’s business is carried on as part of the operation of an entertainment or recreation facility, the “liquor outlet” shall be deemed to include the entire entertainment or recreation facility and associated areas.

“Robinson Rancheria Indian Country” shall mean Indian Country as defined by 18 U.S.C. Section 1151 subject to the jurisdiction of the Robinson Rancheria, including, but not limited to, any lands and waters held in trust by the federal government within the jurisdiction of the Robinson Rancheria.

“Sale” shall mean the transfer, exchange or barter, in any or by any means whatsoever, for a consideration, by any person, association, partnership, or corporation, of liquor or beer products.

“Strong beer” shall mean any beer, including ale, stout and porter, containing more than four present of alcohol by weight.

“Tribal council” shall mean all enrolled members of the Robinson Rancheria, 18 years of age or older.

“Tribe” shall mean the Robinson Rancheria.

“Wholesale price” shall mean the established price for which liquor and beer products are sold to the Robinson Rancheria or any licensee by the manufacturer or distributor, exclusive of any discount or other reduction.

“Wine” shall mean any alcoholic beverage obtained by fermentation of fruits (grapes, berries, apples, etc.) or other agricultural product containing sugar, to which any saccharine substances may have been added before, during or after fermentation, and containing not more than 17 percent of alcohol by weight, including sweet wines fortified with wine spirits such as port, sherry, muscatel, and angelica, not exceeding 17 percent of alcohol by weight.
